Nevada Gov. Steve Sisolak signs bill restoring prevailing wages (NV)

Gov. Steve Sisolak on Tuesday signed legislation repealing changes made by the Republican dominated 2015 Legislature that weakened Nevada’s prevailing wage laws.

The GOP raised the threshold for projects to require contractors pay prevailing wage from $100,000 to $250,000. They also directed the Labor Commissioner to set prevailing wages for public school and higher education construction projects at 90 percent of what would be required for other public works projects.

AB136 repeals both of those changes, restoring the law to what it was before 2015.
In addition, he signed SB231 which repealed language basically prohibiting contractors and subcontractors from entering into or adhering to any agreement with labor organizations when working on public projects. SB231 eliminates language that strongly discouraged public bodies from hiring contractors who have agreements with unions and prohibits public bodies from awarding grants, tax abatements credits or exemptions to contractors that enter agreements with labor organizations.

Sisolak said he was keeping his campaign promise to “return prevailing wage to public construction projects.”

He said that will help guarantee public construction projects are built by highly qualified workers and increase competition among those contractors.

Attorney General James Announces Guilty Pleas of Valley Stream Construction Contractors for Failing to Pay Workers (NY)

Vickram and Gayatri Mangru, Owners Of Vick Construction and AVM Construction Corp., Pleaded Guilty to Failure To Pay Prevailing Wages On Construction Work at Several New York City Public Schools.

New York, NY – February 12, 2019 – Attorney General Letitia James today announced the guilty pleas of Vickram Mangru, his wife Gayatri Mangru, and AVM Construction Corp., of Valley Stream, NY, for failing to pay proper prevailing wages to workers and falsifying business records related to a publicly-funded New York City construction project. The defendants were charged with failing to pay three workers their required prevailing and overtime wages, as well as supplemental benefits from December 2012 through February 2015. The defendants unlawfully falsified payroll records to conceal their crimes, and thereby stole more than $280,000 from three workers. In October 2017, a Bronx County Grand Jury returned an indictment charging the defendants with two counts of Failure to Pay Prevailing Wages and Benefits and two counts of Falsifying Business Records in the First Degree.

“Intentionally underpaying workers is both highly illegal and immoral,” said Attorney General Letitia James. “Not only did the defendants take advantage of innocent workers trying to earn a living, they also took advantage of New York City by falsifying records to the Department of Education. This office will never hesitate to investigate any employer who tries to cheat our workers or our government.”

In addition, all defendants will be barred from bidding on or being awarded any public works contract in the State of New York for a period of five (5) years.    

“An honest days work deserves an honest days pay and when employers cheat workers from the wages they rightfully earned, regardless of their status,  it’s labor abuse at its worst,” said New York City Comptroller Scott Stringer. “Despite being debarred, this unscrupulous contractor attempted to use his wife’s name to open a company and take advantage of immigrant workers by withholding their prevailing wages yet again – now he is facing the consequences of his actions. I would like to thank the Attorney General for working side by side with my office to prosecute this contractor and bring justice to the workers who are owed their fair share.”

A.G. Schneiderman Announces Arrest Of Public Works Contractor Charged With Wage Theft Of Nearly $700K

Defendant Allegedly Failed To Pay $691,040 In Prevailing Wages And Benefits To Ten Workers Performing Construction On Bronx Public Schools.

New York, NY – May 3, 2017 – Today, Attorney General Eric T. Schneideman and New York City Comptroller Scott M. Stringer announced the arrest of contractor Vickram Mangru on charges that he underpaid wages and benefits to workers on a publicly-funded New York City construction project. The arrest is part of an ongoing investigation into widespread allegations of prevailing wage theft at New York City public works projects.

Contracted to perform work on several New York City Department of Education (NYCDOE) public schools in the Bronx between December 2012 and April 2014, Mangru – while doing business as Vick Construction out of Valley Stream, New York -was charged with allegedly cheating six workers out of $301,683 in wages. Vick Construction and Mangru had previously been debarred and banned for a five-year period from performing public work projects by the New York City Comptroller’s Office for failing to pay proper prevailing wages to workers. On December 31, 2013, Mangru entered into a settlement agreement, admitting he underpaid workers by $34,347 in prevailing wages and supplements.

Undeterred, Mangru allegedly continued to operate in several public schools and continued to pay well below proper prevailing wage rates, forming AVM Construction in January 2014. AVM Construction was purportedly owned by Mangru’s son Ravi Mangru and his wife Gayatri Mangru, who both claimed to be the company’s president. However, according to workers, Mangru ran the day to day operations of AVM Construction, including directly supervising the work and paying employees.

Between April 2014 and February 2015, Mangru is alleged to have continued working on multiple NYCDOE school projects in the Bronx. An investigation determined that Mangru, now operating under the umbrella of AVM Construction, allegedly failed to pay proper prevailing wages to ten workers on those school projects by an additional $389,357 during the ten-month period.

In total, Mangru allegedly failed to pay $691,040 in prevailing wages and benefits to ten workers, from December 2012 to February 2015.
